The debate concerning the so-called U.S. Health and Human Services Contraception Mandate has been adequately framed, in the academic field, within the traditional ethical doctrine on cooperation with evil. This principle will allow us to conclude whether employers may ethically comply with the onerous existing law or not. The discussion has been quite heated, because the practical conclusions authors have reached vary widely, depending on which interpretation of the theory they rely on. In this paper, some of these explanations are (...) addressed and analyzed from the standpoint of the Thomistic theory of action, which is now the most common point of view. This work concludes that, although the Contraception Mandate will most likely be repealed by the current U.S. administration, as things once stood, compliance with it may have been ethically licit in some cases. Drunk drivers and other culpably incapacitated wrongdoers are often taken to pose a problem for reasons-responsiveness accounts of moral responsibility. These accounts predicate moral responsibility upon an agent having the capacities to perceive and act upon moral reasons, and the culpably incapacitated wrongdoers lack exactly those capacities at the time of their wrongdoing. Many reasons-responsiveness advocates thus expand their account of responsibility to include a tracing condition: The culpably incapacitated wrongdoer is blameworthy despite his incapacitation precisely because he is responsible (...) for becoming incapacitated. As some skeptics have suggested, it is not clear that we need tracing. Here, however, I make a stronger case against tracing: I show that tracing gets things wrong. I consider a new sort of case, the case of the Odysseus agent, whose incapacitation is non-culpable (sometimes merely permissible and sometimes praiseworthy). Tracing would have us hold responsible and therefore blame unlucky Odysseus agents, Odysseus agents who commit a wrongdoing in the throes of their non-culpably induced incapacitation. But we should not hold these unlucky Odysseus agents responsible for their incapacitated wrongdoing. Because tracing gets these cases wrong, we should reject tracing. (shrink)

For many philosophers, bad-history wrongdoers are primarily interesting because of what their cases might tell us about the interaction of moral responsibility and history. However, philosophers focusing on blameworthiness have overlooked important questions about blame itself. These bad-history cases are complicated because blame and sympathy are both fitting. When we are careful to consider the rich natures of those two reactions, we see that they conflict in several important ways. We should see bad-history cases as cases about whether and how (...) we should blame, rather than as cases giving us ready insight into the nature of moral responsibility. (shrink)

The counterfactual mental state of negligent criminal activity invites skepticism from those who see mental states as essential to responsibility. Here, I offer a revision of the mental state of criminal negligence, one where the mental state at issue is actual and not merely counterfactual. This revision dissolves the worry raised by the skeptic and helps to explain negligence’s comparatively reduced culpability.

Duress is a defense in both law and morality. The bank teller who provides an armed robber with the bank vault combination, the innocent suspect who fabricates a story after hours of interrogation, the Good Samaritan who breaks into a private cabin in the woods to save a stranded hiker, and the father who drives at high speed to rush his injured child to the hospital—in deciding how to respond to agents like these, we should take into account that they (...) have acted under duress. In this paper, I offer a new duress defense, which I call “distinctive duress.” The distinctive-duress defense is neither ordinary justification nor ordinary excuse. Rather, it is a defense available to agents who act wrongly because they are appropriately insensitive to certain reasons. In the distinctive-duress cases, an agent’s normative sensitivities are rightly directed elsewhere, leading them awry. (shrink)

In deciding whether to forgive, we often focus on the wrongdoer, looking for an apology or a change of ways. However, to fully consider whether to forgive, we need to expand our focus from the wrongdoer and their wrongdoing, and we need to consider who we are, what we care about, and what we want to care about. The difference between blame and forgiveness is, at bottom, a difference in priorities. When we blame, we prioritize the wrong, and when we (...) forgive, we shift our priorities away from the wrong. Recognizing this essential role for priorities in forgiveness allows us to address a thorny puzzle in thinking about forgiveness: how is it that forgiveness can be both principled and elective? If there is sufficient reason to forgive, as will sometimes be the case because forgiveness is principled, how can it be reasonable to withhold forgiveness? Recognizing that forgiveness is a shift in our priorities dissolves this apparent tension between forgiveness being principled and forgiveness being elective. (shrink)

Emotions are the focus of intense debate both in contemporary philosophy and psychology, and increasingly also in the history of ideas. Simo Knuuttila presents a comprehensive survey of philosophical theories of emotion from Plato to Renaissance times, combining rigorous philosophical analysis with careful historical reconstruction. The first part of the book covers the conceptions of Plato and Aristotle and later ancient views from Stoicism to Neoplatonism and, in addition, their reception and transformation by early Christian thinkers from Clement and Origen (...) to Augustine and Cassian. Knuuttila then proceeds to a discussion of ancient themes in medieval thought, and of new medieval conceptions, codified in the so-called faculty psychology from Avicenna to Aquinas, in thirteenth century taxonomies, and in the voluntarist approach of Duns Scotus, William Ockham, and their followers. The study of the cultural Cold War and East–West interaction outside diplomacy and high politics has emerged as an important research field during the last two decades. With a few exceptions, however, scholarly interaction has been overshadowed by other forms of interaction. Existing research has mostly paid attention to technological exchange and to espionage, which was at times connected with scientific exchanges across the Iron Curtain. This article discusses scholarly exchanges in the human sciences between Finland and the Soviet Union. (...) Even though Finland was a western-style democracy with a market economy, it had close political ties with the Soviet Union, which allowed for the development of active scholarly connections between the countries. We can enrich the explanation of how we should treat kid wrongdoers by recognizing that it matters who does the blaming and punishing. That we should think about who does the blaming and punishing is perhaps unsurprising, but it is nonetheless often underappreciated. Here, I offer two lessons about blame and punishment by thinking about who judges kids. First, the right account of moral and legal responsibility should allow that kids may rightly blame each other, and I argue that we (...) can best accommodate this by relativizing the threshold of competence needed for responsibility. Second, although each kid is an individual and, as a result, the implications of immaturity vary signifi- cantly from kid to kid, we should give kids a break as kids, that is, based on our categorizing them as kids. That we should and do categorize in that way reflects the nature of the criminal justice system as an institution and the nature of us as social beings. (shrink)

Many of those memorialized around us in statues are wrongdoers, and so we are often called to consider whether we should take down those statues. Some of those statutes are memorialized for reasons now taken to be wrong; others are memorialized not for but rather despite their wrongdoing. How should we consider those latter cases? One tempting analysis suggests that we need only consider whether the wrongdoing was sufficiently transgressive. In this article, however, I reject that constrained focus. Instead, these (...) cases have as much to do with us, our priorities, and what those priorities should be as they have to do with the particulars of the lives of the subjects of the statues. Recognizing the central role that our priorities play in blame and condemnation better captures the contours of the debate about statue removal than any categorical rule about types of wrongs. U ovom članku cilj nam je pokazati razmjere te pogreške i njezine implikacije na pitanje globalne pravde. »Pristupom sposobnostima« nudimo mogući smjer u rješavanju nagomilanih multikulturalnih problema te zaključujemo kako jedino ispravnom idejom i realizacijom kreposti pravednosti možemo utemeljiti put u ispravno formiranje svijesti o osobnom i (...) društvenom identitetu.The idea of identity has been distorted by the assumptions of monolith affiliation, the beliefs that each person belongs to one collective only. It is hard to deny the circulation of these monolith approaches nowadays, but the thesis of Nobel Prize winner Amartya Sen about “plural monoculturalism” exposes their reductionist error. In this article our aim is to show the proportions of this error and implications on the question concerning global justice. With the “capability approach” we are offering possible direction in solving some major multicultural problems, and we conclude that only with the right idea and realization of virtue of justice it is possible to establish a way in proper forming of our consciousness about personal and social identity. J.S. Mill has formulated a classical statement of the "argument from analogy� concerning knowledge of other minds: "I must either believe them [other human beings] to be alive, or to be automatons� (Mill 1872, 244). It is possible that Wittgenstein had this in mind when writing the following: "I believe he is suffering.�—Do I also believe that he isn"t an automaton? It would go against the grain to use the word in both connexions. (Or is it like this: I believe (...) he is suffering, but am certain the he is not an automaton? Nonsense!) Suppose I say of a friend: "He isn"t an automaton�.—What information is conveyed by this, and to whom would it be information? To a human being who meets him in ordinary circumstances? What information could it give him? (At the very most that this man always behaves like a human being, and not occasionally like a machine.) "I believe he is not an automaton�, just like that, so far makes no sense. My attitude towards him is an attitude towards a soul [eine Einstellung zur Seele]. I am not of the opinion that he has a soul. (PI p. 178) Here Wittgenstein contrasts opinion (Meinung) and attitude (Einstellung). How should this contrast be understood? On a view such as Mill"s, to regard someone as a conscious being is to hold certain beliefs about him, beliefs that can perhaps ultimately be grounded in a theory of some sort. To have an "attitude towards a soul� is, on the contrary, to see a person"s gestures and facial expressions as "filled with meaning�. We have an attitude towards a soul when confronted with a person, which means that we react to his presence and behaviour in a certain way. (shrink)

It is now a common opinion in Western countries that a child's impairment would probably place an unexpected burden on her parents, a burden that the parents have not committed themselves to dealing with. Therefore, selective abortion is in general a morally justified option for the parents. I argue that this view is based on biased information about the quality of life of individuals with impairments and their families. Also, a conscious decision to procreate should bring about conscious assent to (...) assuming obligations as a parent. This implies a duty of caring for any kind of child. Consequently, if the child's condition is not such that it would make its life not worth living, and if the parents live in an environment where they are able to provide their child and themselves an adequate well-being, they do not have a morally sufficient reason to terminate the pregnancy on the grounds of fetal abnormality. Celem artykułu jest pokazanie możliwości zastosowania J.M. Bocheńskiego koncepcji zabobonu filozoficznego (pogląd fałszywy stwarzający pozory prawdziwości) w analizie etycznych ocen i argumentacji. Dla osiągnięcia tego celu koncepcja Bocheńskiego jest najpierw omówiona, następnie wskazane są cechy myślenia etycznego sprzyjające jego podatności na zabobony filozoficzne oraz podjęty jest problem możliwości rozpoznawania i ograniczania zabobonów w refleksji nad moralnością.

Normalmente se supone que los edificios son entidades físicas que forman parte del mundo y, en cuanto a tales, se limitan a ser elementos materiales del mismo. Ahora bien, si, como sostiene Nelson Goodman, se considera que los edificios son también símbolos, entonces esta concepción simplificada se enriquece y la arquitectura adquiere una dimensión epistemológica con consecuencias ontológicas cruciales. Desde esta perspectiva, ya no es el material constructivo el que ayuda a construir el mundo, sino los múltiples significados de los (...) edificios: en cuanto a símbolos, los edificios contribuyen al proceso de construcción de mundos. A partir de nociones clave de la filosofía de Goodman y mediante el análisis de varios ejemplos, el presente artículo examina de qué forma los edificios contribuyen de manera particular tanto a dar un significado como a crear mundos. This paper discusses the issues of deciding to have a child with mental retardation, and of terminating a pregnancy when the future child is known to have the same disability. I discuss these problems by criticizing a utilitarian argument, namely, that one should act in a way that results in less suffering and less limited opportunity in the world. My argument is that future parents ought to assume a strong responsibility towards the well-being of their prospective children when they decide (...) to reproduce. The moral point in cases in which our acts affect the well-being of future children should be expressed strictly in terms of parents' culpability. Future children thus do not have current moral standing but presently living persons have current obligations to consider the presumable effects of their actions on future people. I will also argue that there are morally significant differences between 'selective contraception' and selective abortion. (shrink)

In this review I provide a brief analysis of the main features of the collective volume Shifting Concepts (Oxford University Press, 2020), edited by Teresa Marques and Åsa Wikforss. The volume addresses several related topics, and it contains contributions from psychologists and philosophers. It deals with the topic of concept variation understood in a broad sense, for it tackles diachronic, contextual, interpersonal and even intrapersonal variation; besides, the second part of the book is devoted to the topic of concept revision (...) and amelioration. I provide a brief description of the book and then I critically assess each of the contributions. (shrink)

Semanticists often restrict their theories by imposing constraints on the parameters that can be employed for interpreting the expressions of a language. Such constraints are based on non-logical features of actual contexts of utterance, but they often have important effects on issues that do pertain to logic, like analyticity or entailment. For example, Kaplan’s restriction to so-called “proper contexts” was required in order to count “I am here now” as valid. In this paper I argue that constraints of this kind (...) are often posited in an arbitrary and non-consistent way, and that they yield the intended results only at the price of imposing ad hoc principles whose justification could in turn justify further, often undesirable restrictions into the theory. I also introduce a criterion for telling whether such constraints are imposed in a legitimate manner. (shrink)

In this paper I defend two claims regarding complex demonstratives. On the one hand I argue that, when one of these expressions misdescribes the referred object, the right semantic analysis is to treat the expression as uninterpretable. On the other, I claim that the uninterpretability thesis finds itself in trouble when it comes to dealing with non-deictic uses of complex demonstratives, i.e., uses of “that F” in which the speaker has no acquaintance or direct perception of any object that could (...) satisfy the predicative material. In order to make these two claims compatible, I set out to modify the way the uninterpretability thesis has been traditionally formulated. (shrink)

This article provides the first historiographical analysis of the origins of Jewish Orthodoxy in Helsinki and describes the development of the rabbinate from the establishment of the congregation in the late 1850s up to the early 1980s. The origins of the Finnish Jewish community lies in the nineteenth-century Russian army. The majority of Jewish soldiers in Helsinki originated from the realm of Lithuanian Jewish culture, that is, mainly non-Hasidic Jewish Orthodoxy that emerged in the late eighteenth century. Initially, the Finnish (...) Jewish religious establishment continued this Orthodox-Litvak tradition. After the independence of Finland, the Helsinki congregation hired academic, Modern Orthodox rabbis educated in Western Europe. Following the devastation of the Shoah and the Second World War, the recruitment of rabbis faced new challenges. Overall, the rabbi recruitments were in congruence with the social and cultural development of the Helsinki community, yet respected its Orthodox roots. (shrink)

The word "modem" in the title of this book refers primarily to post-medieval discussions, but it also hints at those medieval mo dal theories which were considered modem in contradistinction to ancient conceptions and which in different ways influenced philosophical discussions during the early modem period. The me dieval developments are investigated in the opening paper, 'The Foundations of Modality and Conceivability in Descartes and His Predecessors', by Lilli Alanen and Simo Knuuttila. Boethius's works from the early sixth century belonged (...) to the sources from which early medieval thinkers obtained their knowledge of ancient thought. They offered extensive discus sions of traditional modal conceptions the basic forms of which were: (1) the paradigm of possibility as a potency striving to realize itself; (2) the "statistical" interpretation of modal no tions where necessity means actuality in all relevant cases or omnitemporal actuality, possibility means actuality in some rel evant cases or sometimes, and impossibility means omnitemporal non-actuality; and (3) the "logical" definition of possibility as something which, being assumed, results in nothing contradic tory. Boethius accepted the Aristotelian view according to which total possibilities in the first sense must prove their met tle through actualization and possibilities in the third sense are assumed to be realized in our actual history. On these presump tions, all of the above-mentioned ancient paradigms imply the Principle of Plenitude according to which no genuine possibility remains unrealized. (shrink)

This article considers three medieval approaches to the problem of future contingent propositions in chapter 9 of Aristotle's _De interpretatione_. While Boethius assumed that God's atemporal knowledge infallibly pertains to historical events, he was inclined to believe that Aristotle correctly taught that future contingent propositions are not antecedently true or false, even though they may be characterized as true-or-false. Aquinas also tried to combine the allegedly Aristotelian view of the disjunctive truth-value of future contingent propositions with the conception of all (...) things being timelessly present to God's knowledge. The second approach was formulated by Peter Abelard who argued that in Aristotle's view future contingent propositions are true or false, not merely true-or-false, and that the antecedent truth of future propositions does not necessitate things in the world. After Duns Scotus, many late medieval thinkers thought like Abelard, particularly because of their new interpretation of contingency, but they did not believe, with the exception of John Buridan, that this was an Aristotelian view. Activities protesting against major polluters who cause climate change may cause damage to private property in the process. This paper investigates the case for a more international general basis of moral justification for such protests. Specific reference is made to the Kingsnorth case, which involved a protest by Greenpeace against coal-powered electricity generation in the UK. An appeal is made to Rawlsian fairness arguments, traditionally employed to support the obligation of citizens to their national governments as opposed to their international (...) duties. The argument made here, however, is that there seem to be sufficient reasons for holding that a stable climate is one of the first truly global public goods that is indispensable to acceptable standards of living everywhere. This would suffice to justify international and intergenerational ‘atmospheric’ political obligations, which in turn may justify protests – even those causing some damage to private property – against the laws and policies that violate the fair terms of cooperation in providing a stable climate. The fairness argument aims also to provide a ground from which Green political theory could integrate accounts of radical forms of citizenship into appeals to state political authority. This leads to justifying acts of civil disobedience on the basis of novel understandings of ‘atmospheric’ citizenship obligations. (shrink)

Originally published in 1993, Modalities in Medieval Philosophy looks at the idea of modality as multiplicity of reference with respect to alternative domains. The book examines how this emerged in early medieval discussions and addresses how it was originally influenced by the theological conception of God acting by choice. After a discussion of ancient modal paradigms, the author traces the interplay of old and new modal views in medieval logic and semantics, philosophy and theology. A detailed account is given of (...) late medieval discussions of the new modal logic, epistemic logic, and the logic norms. These theories show striking similarities to some basic tenets of contemporary approaches to modal matters. This work will be of considerable interest to historians of philosophy and ideas and philosophers of logic and metaphysics. (shrink)
